According to the 63rd District Judge Tom Lee, former City
Manager David Luna is scheduled to appear for trial in Del Rio on August 11, at
9 am.
Luna is accused of intentionally and knowingly, unlawfully
appropriating funds of $1,500 or more, but less than $20,000 without the
effective written consent of the owner (City of Brackettville).

The offense is punishable by two to ten years in
a state jail facility and a fine of up to $10,000.
Luna is also accused of unlawfully appropriating
funds of $20,000 or more, but less than $100,000 between June 9, 2001 and June
8, 2002 and for unlawfully appropriating funds of $20,000 or more, but less than
$100,000 from July 1, 1998 to June 8, 2001. |

Luna’s case was reset in Kinney County on numerous occasions
before his attorney, Tony Reyes of Nicholas & Barrera requested a change of
venue due to his belief that Luna would not receive a fair trial in Kinney
County.
Luna will appear before the court in the Val Verde County Judicial Complex on
the corner of Broadway and Main.
